General Terms & Conditions

Article 1. Definitions
- Childcare: Paid care or supervision provided by qualified staff for children up until the day they start attending high school.
- Parent: Both parents or a single parent as intended in the Childcare Act [Wet kinderopvang], who applies for Childcare Allowance [Kinderopvangtoeslag] through GlobalParentz based on the Childcare regulations [Kinderopvangregeling].
- Partner: A Partner is referred to as intended in the Childcare Act [Wet Kinderopvang].
- Parental contribution: The difference between the Childcare Allowance received and the daycare cost paid.
Article 2. General
- Parents will be deemed to be aware of the GlobalParentz procedures.
- GlobalParentz acts as an intermediary on behalf of the Parent.
Article 3. Invoices and payment terms
- Parental contribution and subscription fee are normally invoiced in advance.
- Invoices are stored and available on a personal webpage, which is solely accessible by the parent and the GlobalParentz administrator.
- GlobalParentz has a payment term of 14 days after the date of invoice.
Article 4. Payments by automatic debit order
- If an automatic debit fails, the payment obligation will nonetheless continue to apply and an administrative fee of €5,-- will be charged.
- The Parent is allowed to request their bank to credit the amount which was debited automatically within 30 days. Such request does not suspend the Parents' obligation to pay.
Article 5. Payment default
- If no payment is received within 14 days after the date of invoice, the Parent is rendered to be in default.
- From the date on which the other party is in default, interest shall be payable on the arrears at 2% per month, a portion of a month being regarded as a full month.
- If the GlobalParentz does not receive payment within the said 14 days, the Parent shall, in addition to the amount due and the interest payable on that amount, pay in-full all extrajudicial and judicial costs of collection, including the costs of lawyers, bailiffs, debt collection agencies and other legal advisors. The extrajudicial costs are set at 15% minimum of the principal sum with a minimum of € 125.
- Any payments by the Parent shall firstly be deducted from the costs of collection, then from the interest payable and finally from the principal sum and the accrued interest.
- If the Parent wishes to pay several invoices, the payments shall be charged in order of invoice date, regardless whether the Parent's statement is different.
- GlobalParentz reserves the right to terminate the registration of the Parent if payment arrears of one or more months have accrued.
- Upon termination of the registration, GlobalParentz withholds the right to continue receiving the Childcare allowance on behalf of the Parent until all deficits are settled.
Article 6. Changes to charges
- GlobalParentz has the right to revise its service fee.
- The parent shall be informed, in writing, a minimum of 60 days in advance of any revision of GlobalParentz's service fee.
Article 7. Disputes
- If the Parent does not agree with the service provided or the invoice, the Parent shall file a written complaint within 14 days after the date of invoice, carefully describing the nature and reason for the complaints. Complaints do not suspend the Parent's obligation to pay. If GlobalParentz, 14 days of the invoice date, has received no written complaint, GlobalParentz will assume that the Parent is in agreement and will not deliberate any further disagreements brought forward beyond this point.

Where there are grounds for disputing the issue, the payment obligation will remain.
Article 8. Unforeseen circumstances.
- In case one or more conditions of this agreement are void or destroyed, the remaining conditions of this agreement remain intact. As much as possible both parties will replace the void- or destroyed conditions by valid conditions whereby as much affiliation as possible is sought.
Article 9. Governing Law and choice of Forum.
- Dutch law is exclusively applicable to all services provided by GlobalParentz included in the Agreements.

Agreements shall be governed by the laws of The Netherlands and submitted to the exclusive jurisdiction of the court in Amsterdam.
Article 10. Privacy Statement
- GlobalParentz maintains a database, which contains the family's details. The Parent will agree to the registration of these details. These details will be treated confidentially.
- GlobalParentz will always act in accordance with the Data Protection Act [Wet bescherming persoonsgegevens].
- GlobalParentz will solely file the private details of its clients, for its own administration.
- GlobalParentz will only provide necessary information to relevant government agencies.
- GlobalParentz will not provide the parents' personal details to other parties than relevant government agencies without prior written approval from the parent(s).
Article 11. Alterations to the General Terms & Conditions
- GlobalParentz has the right to revise these General Terms & Conditions whenever deemed necessary.
- The Parent will be informed of such changes in writing by email.
- Changes will be communicated at least one month in advance.
- If the Parent wishes to terminate the agreement due to the said changes, he/she may do so giving 30 days notice.
Article 12. Liability
- The Parent provides all relevant information and details which are used, Subsequent to GlobalParentz submitting the applicable information to the tax office, the Parent will receive written confirmation of the application made their behalf from the Tax Office.
- GlobalParentz will decline all responsibility for inaccuracies submitted on behalf of the requesting Parent.
- GlobalParentz only accepts a maximum liability up to the amount of the service fee charged monthly to the Parent, exclusive of VAT, during the term of service provided.
- GlobalParentz shall not be liable for any financial, consequential or immaterial loss.
- The Parent shall indemnify GlobalParentz against any claims by third parties related to the loss and damage referred to in this Article.
